Exercising Votes

Last Updated: 7 May 2024

Why exercise your vote?

As a creditor in the external administration, you have a right to exercise a vote on certain matters. Votes allow creditors to nominate how key matters are handled, such as the next steps for a company, whether to appoint committees to oversee the process and approval of the practitioner's remuneration.

Logging in

To exercise your vote, you must first login with the Creditor ID and passcode provided to you by the insolvency practitioner. In some matters, the practitioner may allow you to create your own account by clicking the 'Register New Creditor' button. In the event you did not received login credentials and the 'Register New Creditor' button is not available, please contact the practitioner.

Nominating a Proxy

If a resolution is set to be tabled at a meeting, you will need to nominate who will be exercising the vote at the meeting. You are able to nominate:

  • The creditor personally: If the creditor is a person (not a legal entity such as a company), they may attend the meeting and exercise their votes,
  • A representative of the creditor: The creditor can nominate a person to attend the meeting and exercise votes on their behalf, or
  • The chairperson: If the creditor doesn't plan to attend the meeting, they may nominate the Chairperson to exercise votes on their behalf.

When nominating a proxy you may nominate them as either:

  • Special Proxy: You are able to direct how the proxy will vote on each poll, or
  • General Proxy: An email will be sent to the general proxy and they will be allowed to choose how to vote.

Exercise Votes

On each poll, you need to choose whether to vote for, against or abstain.

Once you have exercised your vote on each poll click 'Submit'.

Note, if you have nominated a general proxy above, you will not need to choose how to vote because an email will be sent to the General Proxy and they will choose.

Attend the meeting of creditors

Certain polls require your attendance at the meeting of creditors in order for your vote to be counted.

If the creditor or a representative are unable to attend, it is recommended that they nominate the Chairperson as their proxy to attend on their behalf.
